The Governance Committee found this policy to be outdated and unnecessary as it was adopted in 1993 before the Health Insurance Portability and Accountability Act of 1996 (HIPAA) was signed into law and further rules to protect health information were adopted with the HIPAA Privacy Rule in 2003; therefore, be it 
Resolution
Resolved, that ASDA’s Current Statements of Position or Policy ‘I-8 Confidentiality of Student Health Status (1993)’ be rescinded:

It is the position of the American Student Dental Association that every dental school has an ethical obligation to protect the privacy and confidentiality of any student, staff, or faculty member found to be infected with HIV or HBV.
